According to facts, a two-member IHC bench comprised of Justice Amir Farooq and Justice Saman Rafat Imtiaz overruled the single-member IHC court’s decision.
The court has also ordered the Federal Government and petitioner Imtiaz Ali Qureshi, the former Chairman of PEIRA, to respond at the case’s next hearing.
He had expressed his displeasure with the Education Ministry for failing to submit a record of the employment of PEIRA Chairpersons throughout the years.
Justice Kiyani further directed the Establishment Division to appoint a committee to evaluate if the record had been lost as stated by the Ministry and to refer the case to the Federal Investigation Agency (FIA) if the Ministry’s explanation proved incorrect.

However, the IHC’s two-member bench has now overridden the single-member court’s decision, which means Zia Batool will continue to serve as Chairperson PEIRA and no further action will be taken against her nomination.
